Terms and Conditions of Use

These Terms and Conditions (“Terms”) govern your access to and use of the websites, products, services, and business opportunities (collectively, the “Offerings”) provided by Avent Herbal Products, a division of Kwa Bhubezi Wholesale and Distributors (“Company,” “we,” “us,” or “our”). By accessing or using any Avent Herbal Products website (the “Site”), purchasing or using our products or services, or participating in our business opportunity, you agree to be bound by these Terms.

1. Acceptance of Terms

Your use of the Site, including all content, data, software, images, and materials (“Content”)  and your purchase or use of any Offerings constitutes your acceptance of these Terms. If you do not agree, your sole remedy is to stop using the Site and Offerings, subject to the Avent Herbal Products Customer Guarantee (Section 6).

2. Changes to These Terms

We reserve the right to:

  • Amend these Terms at any time; and
  • Modify, suspend, or discontinue the Site or Offerings, in whole or in part, at our sole discretion.

Changes take effect immediately upon notice, given either by email or by posting on the Site. Your continued use after such notice constitutes acceptance. Please review these Terms periodically for updates.

3. Access Requirements

You are responsible for:

  • Arranging and paying for your own internet access and equipment; and
  • Maintaining your hardware and software and protecting against viruses.

We accept no liability for errors or malfunctions relating to your devices or software.

4. Eligibility

You must be at least 18 years old to use the Site or Offerings. Avent Herbal Products and its business opportunity are available only in pre authorised countries. For a current list, contact us at info@aventherbalproducts.co.za.

5. Independent Distributors

Our products are sold through a network of Independent Distributors. Purchasing products does not require you to become a Distributor. For Distributor enquiries, contact:

Distributor Websites: Independent Distributors may operate their own websites but must comply with all Avent Herbal Products policies, including our Rules of Conduct and Distributor Policies. We accept no liability for the content of Distributor websites.

6. Customer Guarantee

We guarantee the quality of all products bearing the Avent Herbal Products name. If you are dissatisfied with a product purchased from a Distributor, you may request a refund or exchange within 15 days of receipt. Return the product to your Distributor for a full refund or credit. This guarantee excludes intentional damage or misuse.

7. Privacy and Data

You agree to provide accurate, current, and complete information when using the Site. Our Privacy Policy governs how we collect, use, and disclose your data. Updates to the Privacy Policy take effect immediately upon notice.

8. Acceptable Use

You agree not to:

  • Use the Site or Offerings for any unlawful purpose or to harm minors;
  • Misrepresent your identity or affiliations;
  • Reverse engineer, decompile, or disassemble any part of the Site or Offerings;
  • Infringe intellectual property rights or engage in unauthorised framing or mirroring; or
  • Link to the Site from any website that makes unverified health claims.

9. Intellectual Property

All Content, trademarks, logos, and software on the Site and Offerings are owned by Avent Herbal Products or its licensors and are protected by intellectual property laws. You are granted a limited, non exclusive, non transferable licence to access the Site for personal use only. Unauthorised reproduction, modification, or distribution is prohibited.

10. Submissions

Any ideas, suggestions, or testimonials you submit to us may be used without restriction or compensation. You warrant that your submissions do not infringe the rights of any third party.

11. Third Party Links and Content

Links to third party websites are provided for your convenience only. We do not endorse or control external content and accept no liability for such resources.

12. Disclaimers and Limitation of Liability

  • Site and Offerings: Provided “as is,” without warranties of merchantability, fitness for a particular purpose, or non-infringement, except as set out in Section 6.
  • No Guarantees: We do not warrant that access to the Site will be uninterrupted, error free, or secure.
  • Liability Cap: We are not liable for any indirect, incidental, or consequential damages, including lost profits or data loss, arising from your use of the Site or Offerings, even if we have been advised of the possibility of such damages.

13. Indemnification

You agree to indemnify Avent Herbal Products, its affiliates, and its Distributors against any claims, damages, or costs arising from:

  • Your breach of these Terms;
  • Your unauthorised use of the Site or Offerings; or
  • Your infringement of third party rights.

14. Termination

We may terminate your access to the Site or Offerings, or modify or discontinue our services, at any time and without notice. Termination does not entitle you to any compensation for losses.

15. Governing Law

These Terms are governed by and construed in accordance with the laws of the Republic of South Africa, and you agree to submit to the jurisdiction of its courts.
